The Fincher member agreement
Fincher is a social network for the people you actually know. These terms are the agreement between you and us, Finchproof LLC (“Finchproof,” “we”), which runs Fincher. We’ve tried to write them so you can read them in a few minutes. By using Fincher you agree to them, together with our Privacy Policy.
1. Your work stays yours
You keep the copyright and every other right in what you post: photos, videos, stories, captions, comments and messages. We don’t own any of it, and we never will.
To run Fincher, you give us a narrow permission (a “license”) to store your content, process it and show it, and only to the people you’ve chosen: your connections, the members of a clique you post in, or the person you message. “Process” means things like removing hidden details (location, camera model), resizing, converting formats and adding Finchproof’s invisible marks (section 3). This license:
- is only for operating Fincher for you and the people you share with;
- doesn’t let us sell your content, show ads with it, or give it to anyone else to use;
- doesn’t let us, or anyone we work with, use your content to train artificial intelligence;
- ends when you delete the content or your account, apart from the limited records described in our Privacy Policy.
2. No AI training, no scraping
Members’ work is on Fincher to be shared with friends, not harvested. You agree not to:
- use anything you see on Fincher to train, test or improve an AI model, or help anyone else do so;
- copy content in bulk, scrape the site, or use bots or automated tools to collect content;
- remove or tamper with the invisible marks in photos or videos;
- repost someone else’s content outside Fincher without their permission.
3. Finchproof protection
Fincher is part of Finchproof, which protects creators’ work from unauthorized AI training and helps prove it when it happens. Our plan is that every photo you see on Fincher carries an invisible mark made for you as the viewer, so that a copy that turns up somewhere it shouldn’t (in a dataset, or coming out of an AI model) can be traced to the account it was shown to.
Status: this marking is being built and is not yet switched on. We’ll update these terms and tell members before it starts.
Once marking is on, if a copy of a member’s work is traced to your account, we may suspend or close the account. We may also share the finding with the member whose work it is, so they can protect their rights, including in legal proceedings. A trace shows which account’s copy it was. It doesn’t by itself prove who used the account, so we treat it as a starting point, not a verdict.
4. Your account
- Fincher is for real people using their real identity. One account per person.
- You must be at least [minimum age, to be decided: 13, 16 or 18] to use Fincher.
- Keep your password to yourself; you’re responsible for what happens on your account.
- Anyone can see your name and profile picture. Everything else is visible only to your connections.
5. Treat people well
Don’t use Fincher to:
- harass, threaten or impersonate anyone;
- post anything illegal, or anything that exploits or endangers children;
- post someone else’s private information or intimate images without their consent;
- spam people, or post malware;
- get around another member’s choices, such as a declined tag or connection.
Tags need the tagged person’s approval before anyone sees them, and only people who have accepted your connection can message you.
6. Membership
Fincher is free while it grows. If paid plans come later, we’ll tell you in advance and you can decide whether to stay. Members who joined among the first 1,000 accounts are founding members, free for life. [To confirm with counsel: exactly what “free for life” covers.]
7. Copyright complaints
If you believe something on Fincher infringes your copyright, contact our copyright agent at [designated agent and address] with the details the U.S. Digital Millennium Copyright Act asks for. We remove infringing content, and we close the accounts of repeat infringers.
8. Ending things
You can stop using Fincher at any time; to delete your account, contact us at [contact email] until self-service deletion is built. We may suspend or close accounts that break these terms. Sections 1 (as it applies to content still held), 2, 3, 9 and 10 survive the end of this agreement.
9. The service, as is
We work hard to keep Fincher running and your content safe, but we provide it “as is,” without warranties, to the extent the law allows. [Limitation-of-liability amount and wording to be decided with counsel.]
10. Law and changes
These terms are governed by the laws of [state] and the United States. If we change them in a way that matters, we’ll tell you and ask you to agree again before you keep using Fincher.
